| Judge grants Jungo's temporary stay |

WINNEMUCCA — Jungo Land & Investments has received the temporary stay requested at the time they filed suit against Humboldt County and the Humboldt County Board of Commissioners. The temporary stay was signed on Thursday (April 29) by Judge Robert Estes -- who received the case after the recusals of 6th Judicial District Court Judges Richard Wagner and Michael Montero.
The lawsuit seeks judicial review of actions taken by the Humboldt County Commissioners to reverse a decision by the Regional Planning Commission, which meant the loss of Jungo's five-year CUP extension that had previously been granted by the RPC. Without the extension, Jungo's original CUP expired on April 23. The stay request was made nunc pro tunc to April 5, meaning the conditional use permit and the five-year extension go back to their April 5 status and will remain in place until a hearing is held in the matter. Jungo is seeking a permanent stay pending judicial review of the case. George McGrath, the Chief Operating Officer for Recology, said in a statement, "We are pleased that the court has agreed to review the legality of actions taken by the Humboldt County Commissioners." Recology is the parent company of Jungo Land & Investments who filed suit on April 22. The suit claims the commissioners violated local and federal laws in reversing the RPC. Jungo is in the process of obtaining permits to build a class 1 landfill on private property on Jungo Rd. |
