WINNEMUCCA — The man arrested in August for allegedly attacking a deputy in an attempted effort to steal her patrol vehicle will go to trial in 6th Judicial District Court.
Sandobal Ezequiel Jacobo, 26, was charged with burglary, battery with the intent to commit a crime, attempted robbery, battery on a peace officer causing substantial bodily harm – all category B felonies – for his alleged attack on Deputy Kathy Green of the Humboldt County Sheriff’s Office.
He was additionally charged with gross misdemeanor indecent exposure for allegedly taking off his clothes and exposing himself.
Jacobo in Union Township Justice Court on Tuesday (Dec. 6) for a preliminary hearing in which Justice of the Peace Judge Gene Wambolt ruled there was sufficient evidence to bind the case over for trial.
Green was the only witness to testify.
Green was originally dispatched to the Golconda area on a report of a man potentially burglarizing vehicles. When she arrived she saw a man, later identified as the defendant’s father, yelling for help in the area of a mine parking lot.
Green met with the defendant who she described as moaning and foaming at the mouth. He allegedly collected a mouthful of spit and then spit on Deputy Green.
She said at this point Jacobo hit her, ran past her, and jumped into her patrol vehicle, which was still running. Deputy Green followed and what ensued was a battle between Green and Jacobo for control of her patrol vehicle.
Jacobo put the car in drive and actually drove about 50 feet down the road while Deputy Green struggled to get the car stopped by turning off the ignition.
She alleged he punched her multiple times in the head and allegedly twisted her hand backwards and away from the keys she was attempting to reach.
She eventually got the car stopped. Bystanders aided Green in getting the suspect out of the patrol vehicle and onto the ground where he allegedly lay screaming.
Green pulled out her sidearm, at which point Jacobo calmed down and asked for water.
The calm lasted about one minute before Jacobo was back on his feet -- despite Green’s use of a duty baton. She told the court, “He had no pain threshold."
The defendant started to scream again, which Green described as “primal … a terrible, horrible scream.”
Green said she attempted to taze the subject, but he dropped and rolled on the ground, breaking the wires.
At this point the defendant allegedly took off his clothes, except for his shirt, and headed towards the Watering Hole bar. Green said she chased him but because he was so sweaty he was hard to hold.
Three male bystanders helped Green get the defendant to the ground while he allegedly spit and tried to bite the people holding him down. Eventually, another officer arrived at the scene and with his aid Green was able to handcuff the subject.
Green told the court she has lasting injuries from the struggle – primarily chronic pain in her right hand which may need additional surgery. She said the injuries stem from the defendant twisting her hand away from the ignition.
Deputy Green was off work for a short time period. When she returned her duties were limited, and she only returned to patrol on Sunday (Dec. 4).
Due to the testimony that Jacobo was walking around naked and exposing himself, the additional charge of gross misdemeanor indecent exposure was added to the list of charges. Additionally, the charge of battery on a peace officer causing substantial bodily harm was amended from a gross misdemeanor to a felony due to the long-term nature of the injuries suffered by the deputy.
Jacobo remains at the Humboldt County Detention Center where bail was set at $82,500. |
