The following were the results of arraignment and sentencing hearings for the 6th Judicial District Court - Department 1 on Monday, May 3. Judge Richard Wagner presiding.
ED: Due to recent developments with the Nevada Supreme Court, all cases in Department 1 involving the Public Defender’s Office may be transferred to Department 2 at a later date.
- The case involving Gabriel Raul Zamora-Duenas, charged with attempted sexual assault, battery with the intent to commit sexual assault, and burglary, was on the calendar for a change of plea. However, the defendant changed his mind and the jury trial was set to begin on Aug. 25.
- James Whit Hume Jr. changed his plea to guilty on the charge of child abuse/neglect/endangerment. A sentencing hearing will be set at a later date.
- Scott Rilley Whiffen pleaded not guilty to possession of a controlled substance for sales. A status hearing was set for June 7.
- The case involving Robert Schmid, charged with gross misdemeanor conspiracy to commit battery, was continued until May 17.
- A probation revocation hearing was held on the case involving RJ Jackson, charged with intimidating a public officer. The defendant admitted to all but one of the probation violation allegations. He was ordered to pursue in-house treatment for substance abuse and anger management. The probation violations will be revisited when the defendant completes the above orders.
- Menno DeRijk pleaded guilty to possession of a controlled substance and a sentencing hearing was set for 10:30 a.m. on July 7. The defendant’s plea was part of a negotiated settlement with the Humboldt County DA’s Office. DeRijk was originally arrested on multiple child abuse/neglect/endangerment charges and maintaining a place for the sales of controlled substance, but those charges were dismissed as part of the settlement.
- Sebastian Deleon-Mariscal pleaded not guilty to child abuse/neglect/endangerment and a jury trial was scheduled to begin on July 8.
- The sentencing in the case involving Jared Alan Holm was withheld while the defendant completes substance abuse counseling.
