Technically, the category D felony represents 1-4 years in prison and probation is a possibility. However, the defendant is on an immigration hold and faces deportation back to his native country. Duran-Gamboa was arrested last May and went before the jury in November on sexual assault allegations from a girl who was 12-years-old at the time of the alleged incident. However, a mistrial was called after Humboldt County DA Smith inadvertently made reference to the defendant’s custody status. His trial date has been reset to June 30, July 1 and 2, but the trial date has since been vacated. |
