The following were the results of arraignment and sentencing hearings before Judge Michael Montero of the  6th Judicial District Court - Department 2 on Monday, Jan. 9, 2012.

  • Jose Raul Garcia pleaded guilty to gross misdemeanor conspiracy to commit aggravated assault and a sentencing hearing was set for 10:30 a.m. March 12.
  • The case involving Daniel Lee Lockaby, charged with felony being under the influence of a controlled substance, was remanded to Justice Court and the trial date was vacated.
  • The case involving Gary James Head, charged with felony possession of a controlled substance and being under the influence of a controlled substance,  was continued until 11 a.m. June 4 due to deferred prosecution.
  • The trial for Antonio Rosales Hernandez, charged with transporting a controlled substance, possession of a controlled substance, and being an ex-felon in possession of a firearm, was reset to May 2 and was scheduled for three days.  A hearing on the motion to suppress evidence was set for 10:30 a.m. March 8.
  • The case involving Timothy Ray Simonsen, charged with felony transporting a controlled substance, was remanded to Justice court.
  • Manuel Dezario Castillo pleaded not guilty to felony sales of a controlled substance and a three-day trial was scheduled to begin on March 14.  The defendant also pleaded not guilty to felony transporting a controlled substance and possession of a controlled substance, and a three-day jury trial was scheduled to begin March 21.  A hearing on the motion to suppress evidence was scheduled for 10:30 a.m. Feb. 23.
  • Michael Darren Smith, charged with felony eluding, failed to appear in court and bench warrant was issued for his arrest.  The bench warrant will have no extradition limitations.
  • The cases involving Dennis Henry Hegge, charges with eluding in a manner posing danger and possession of a stolen motor vehicle, were continued for two months.
  • The case involving defendant Dominic Gabiola, charged with contributing to the delinquency of a minor, was continued.
  • The case involving Bobby Lee Marley, charged with child abuse/neglect/endangerment, was continued.
  • Claude J. Peterson, charged with gross misdemeanor failure to pay child support, was sentenced to probation during which child support must be paid as well as back payments.
