WINNEMUCCA — Jungo Land & Investments has filed a cross appeal to the one already filed by the Humboldt County Commissioners to the 9th Circuit Court of Appeals. The cross appeal essentially ensures all issues raised before the US District Court are before the 9th Circuit Court of Appeals. In a decision filed on December 7, 2011, the US District Court issued a ruling that determined the Humboldt County Commissioners exceeded their jurisdiction in actions that resulted in Jungo losing the conditional use permit (CUP) extension granted by the Regional Planning Commission in 2010. Jungo sought a writ of mandamus/writ of prohibition from the US District Court, which was granted. The order restored the CUP extension, allowing Jungo to move forward with the construction of a class 1 landfill on Jungo Road. However, as part of the suit, Jungo also sought a petition for judicial review. The US District Court denied that request and noted the point was moot since the other request was granted, which is the subject of Jungo's cross appeal. |
