Boyles sentenced to prison for attack on wife

WINNEMUCCA — The man who attacked his wife and left her on the floor for dead last November was sentenced to prison on Thursday (May 17) in 6th Judicial District Court.

Quintin Boyles, 34, was sentenced for felony battery causing substantial bodily harm to a prison term of 12-32 months. The charge was reduced from attempted murder as part of a negotiated settlement.

In sentencing the defendant Judge Richard Wagner said, “This is a terrible crime you’re responsible for. You can’t dress it up, you can’t make it look decent, you can’t make it look good for your friends or anyone else.”

Former cop sentenced in sexting case

WINNEMUCCA -- Over a joint recommendation of probation from the defense and prosecution, Judge Richard Wagner sentenced a former law enforcement officer to prison on Monday (May 7).

Matthew Haylett was sentenced for coercion, a category B felony, to 14-36 months in prison for exchanging more than 2400 text messages containing sexual content with a 15-year-old girl.  (shown) Haylett was handcuffed and led from the 6th Judicial District Court.

Defense motion for dismissal fails in battery case

WINNEMUCCA — A defense effort to have a case dismissed after the defendant pleaded guilty to the charges failed and the case will move forward to sentencing.

Quintin Boyles, 35, will be sentenced for battery causing substantial bodily harm at 10 a.m. May 17.

Defendant who stabbed roommate given probation

WINNEMUCCA — The man who pleaded guilty to stabbing his roommate during an argument that started over dirty dishes was sentenced in 6th Judicial District Court on Monday (April 23).

Jorge Luis Ibanez was sentenced for gross misdemeanor conspiracy to commit battery with a deadly weapon and was sentenced to a three-year term of probation with an underlying sentence of 12 months in the Humboldt County Detention Center.

Sentencing stalled over question of competency

WINNEMUCCA — An elderly man who pleaded guilty to a sex crime involving a juvenile has yet to be sentenced after the doctor completing the psychosexual evaluation questioned the defendant's competency.

Ponciano Flores-Vidriales, 75, pleaded guilty in November to attempted lewdness with a child under the age of 14, a category B felony. He faces a possible prison term of 2-20 years but probation is an option.

DA dismisses charges in drug case

WINNEMUCCA — The Humboldt County DA’s Office has dismissed charges in a drug case where all the evidence was previously suppressed.

The DA’s Office had considered appealing the decision to suppress the evidence to the Nevada Supreme Court, but Chief Deputy DA Kevin Pasquale was in the 6th Judicial District Court on Monday (April 16), at which time he indicated they were not taking that course of action.

Evidence suppressed in drug case; DA’s Office mulls appeal

WINNEMUCCA — The evidence in a drug case has been suppressed due to lack of sufficient probable cause to support the search warrant, but the defendant’s May 2 jury trial remains on the court’s calendar as the DA’s Office considers appealing the suppression order.

Antonio R. Hernandez, 34, of Idaho Falls, was arrested in July 2011 and charged with three felonies: transporting a controlled substance, possession of a controlled substance, and ex-felon in possession of a firearm.

Judge Michael Montero ordered the evidence in the case suppressed on April 2 due to the fact the search warrant under which the evidence was obtained was not supported by probable cause, a violation of the Fourth Amendment.

CORRECTED: Man sentenced for parking lot fatality

WINNEMUCCA — The man who fatally struck a pedestrian in the parking lot of Khoury’s Market on September 17 was in 6th Judicial District Court on Monday (April 9) for sentencing.

John Farley, 30, was sentenced for DUI causing death, a category B felony, to 4-16 years in prison with credit for time served of 204 days.  The defendant is shown at right with his attorney Sherburne Macfarlan, of Elko.

SPJ originally reported the defendant received a minimum two-year sentence, which was incorrect and we regret the error.  The minimum sentence was four years in prison.
