The Nevada Legislature is poised to enact a new law that will allow law enforcement to collect DNA at the time of a felony arrest, as opposed to the court collecting DNA at the time of conviction. What do you think?
Sometimes people are arrested then all the charges are dropped. I can't support this expansion of police powers at the expense of the 4th Amendment.
Law enforcement takes fingerprints at the time of arrest and no one complains about that. I'm okay with it.
If convicted, the defendant has to pay a $150 DNA fee. Are suspects going to have to pay that before getting out of jail? Will this increase jail time for poor suspects who can't come up with the money? I'm going to wait and see how this shakes out.
This is the law in other states. I would like to see some statistics showing this expanded police power actually leads to meaningful arrests.
I'm unfamiliar with this legislation.
