WINNEMUCCA — Those summoned for jury duty on Wednesday, July 7 may disregard the notice as the trial has come off the court calendar. Lori Jean Price was scheduled for trial on a felony count of possession of child pornography. However, Chief Deputy DA Brian Williams notified the court late Tuesday (July 6) the DA's Office could not go forward with their case after a decision by Judge Michael Montero earlier in the afternoon blocked their ability to present all the evidence. During a pre-trial hearing, Williams made a motion to present testimony concerning how the defendant allegedly came by the photographs and how authorities found them. Montero denied the motion and ruled the testimony could associate the defendant with past bad acts, which might prejudice her in the eyes of the jury. Williams had argued the testimony was part of presenting the whole picture to the jury, but Montero disagreed. Humboldt County Public Defender Matt Stermitz made a motion to have the case dismissed, which Williams did not object to. However, Williams said he would be appealing the decision by Montero to the Nevada Supreme Court and reserved the right to refile the charges against Price at a later date pending a favorable ruling from the higher court. |
