| Recology seeks judicial review on landfill issue |

WINNEMUCCA — In a petition filed with the 6th Judicial District Court, Recology has asked for judicial review regarding the recent action of the Humboldt County Board of Commissioners overturning its conditional use permits. The company is seeking a stay of the decision until legal review of the County’s Board of Commissioners action can be reviewed and the legality of the action determined. In a statement released on Friday, Spokesman Adam Alberti noted that in April 2007 the Humboldt County Planning Commission held a properly noticed, public meeting and approved Recology’s application for a conditional use permit. The landfill would receive municipal solid waste via rail line from the San Francisco Bay Area. Alberti described the plans for the proposed landfill as state-of-the art. Alberti continued and noted, "Recology, in good faith, has pursued the necessary approvals from the State of Nevada and has spent more than $1 million in studies and fees along with expending thousands of hours of staff time in pursuit of that effort.” Commenting on the issue was Recology’s Chief Operating Officer George McGrath who said, “All we are asking for is fair, legal and proper consideration of our due process rights in this matter. The appeal seeks to stay the action of the Board of County Commissioners until a judge can determine the legality of the Commissioners’ actions.” The case has been assigned to Judge Michael Montero. SPJ will release the details of the petition upon review. |
